Premium Processing: What 15 Business Days Means

Premium processing guarantees an I-140 decision within 15 business days (approximately 3 calendar weeks) of receipt. USCIS can issue an approval, denial, RFE, or Notice of Intent to Deny within that window. If USCIS issues an RFE, the 15-day clock resets after the response is submitted.

Premium processing does not affect the quality of adjudication — it affects only the speed. It is most useful when: (a) the I-140 approval is needed urgently for a concurrent I-485 filing, (b) a client's H-1B status requires the I-140 approval before an extension is possible, or (c) the applicant needs to begin the Priority Date clock for their country of birth as soon as possible.
